Terms of Service

1. Introduction

This agreement ("Agreement") is between you ("Client" "User," or "You") and Next Wave Training, an online strength training service provider. The purpose of this Agreement is to outline your responsibilities and the terms of participation in our assessment process and strength training services.

2. Eligibility

By agreeing and/or purchasing our services, you confirm that:

  • You are at least 18 years of age or have obtained permission from a parent or legal guardian.

  • You are voluntarily choosing to engage in physical fitness training and related assessments.

  • You understand that this program is not a substitute for medical advice, diagnosis, or treatment.

3. Informed Consent

You understand that participating in strength training and fitness programs involves inherent physical risks, including but not limited to muscle soreness, injury, or more serious complications. You voluntarily assume all risks associated with participation in any assessments or training programs offered by Next Wave Training.

You also acknowledge that:

  • There are no guaranteed results.

  • Your progress may depend on factors including effort, consistency, health, and nutrition.

4. Health Disclosure

You affirm that all medical and personal information you provide in this assessment form is accurate and complete to the best of your knowledge. You agree to:

  • Disclose any current or past injuries, chronic conditions, or physical limitations.

  • Answered your Physical Activity Readiness Questionnaire (PAR-Q) honestly to the best of your ability.

  • Consult a licensed medical professional before starting any new fitness or exercise program, especially if you have any existing health concerns.

5. Waiver and Release of Liability

To the fullest extent permitted by law, you hereby release, waive, and dischargeNext Wave Training, its coaches, employees, contractors, and affiliates from any and all claims, liabilities, demands, or causes of action that may arise from your participation in assessments or training services. This includes any claims for injuries, damages, or losses, whether caused by negligence or otherwise.

6. Privacy and Data Use

We collect personal and health information to design safe, personalized training recommendations. By submitting this form, you consent to:

  • The collection, use, and storage of your information in accordance with our Privacy Policy.

  • Our use of anonymized data for internal analysis and service improvement.
    We do not sell or share your personal data with third parties without your explicit consent, except as required by law.

7. Intellectual Property

All training content, assessment tools, and educational materials provided by Next Wave Training are protected intellectual property and may not be copied, distributed, or reused without prior written permission. If it is found that Next Wave Training IP is shared without the given consent of Next Wave Training, the perpetrator’s membership will be terminated and that perpetrator will be prosecuted to the fullest extent of the law.

8. Communication and Consent

By submitting this form, you agree to receive communications from us related to your training, including reminders, updates, or follow-ups via email, SMS, or phone. You may opt out of marketing communications at any time.

9. Payment and Refund

If this assessment or subsequent services involve a fee:

  • All payments are due at the time of booking or submission.

  • Refunds, if offered, are governed by our Refund Policy (linked or attached).

10. Modification of Terms

We reserve the right to modify these Terms & Agreements at any time. If changes are made, we will post the updated terms on our website or notify you via email. Continued use of our services after such updates constitutes acceptance of the revised terms.

11. Governing Law

This Agreement shall be governed and construed in accordance with the laws of New Jersey, without regard to its conflict of law principles.

12. Acknowledgement and Agreement

By checking the box below you confirm that:

  • You have read and understood this entire Agreement.

  • You voluntarily agree to all terms and conditions.

  • You are legally competent to enter into this Agreement.
